Silva was driving an SUV at 5 p.m. and may have fallen asleep at the wheel. California Highway Patrol officers found several medication bottles inside his vehicle. He is also charged with driving under the influence of a drug.
El Cajon Superior Court Judge Daniel Goldstein set a Dec. 10 hearing though it may be delayed. Eakin’s Facebook page says she had attended Grossmont High School and Grossmont College.
Silva was arrested at the scene. A medical issue caused his arraignment to be delayed one day and he remains in jail.
Woman charged with second-degree murder pleads not guilty
Another similar case involving a pedestrian being killed on Woodside Ave. in Lakeside was heard Dec. 1 and a preliminary hearing was set for Feb. 10, 2016 for Katie Ellison McGrosso, 21.
McGrosso is charged with second-degree murder in the Sept. 25 death of Lorraine Kennedy who was also a pedestrian. David Sandale was also injured.
McGrosso is also charged with gross vehicular manslaughter while intoxicated, driving with a measurable blood/alcohol level and DUI with great bodily injury to Sandale. She has pleaded not guilty and remains in the Las Colinas Women’s Detention Facility on $3 million bail.
Judge determines burglar and exhibitionist competent for trial
A judge determined Dec. 2 that Von Ryan Manago, 32, is mentally competent to stand trial for exposing himself to an El Cajon woman inside her home after he allegedly broke inside.
Manago is charged with residential burglary in the June 21 incident in the 500 block of Tamarisk Way in El Cajon as well as indecent exposure. He is also accused of attempted burglary on April 21 and prowling and peeking in other incidents, according to court records.
A 17-year-old girl told El Cajon Police she was being followed by someone who would hide when she turned around and looked at him. El Cajon Police detectives arrested Manago June 22 after he was found sleeping in his vehicle in San Diego.
A 30-year-old woman told police she awoke to see a man exposing himself to her in her bedroom on June 21. He left a blue latex glove in the bedroom as he fled and police could not locate him then in the area.
Manago’s attorney earlier told an El Cajon judge he doubted Manago was mentally competent to stand trial. San Diego Superior Court Judge Stephen Stone found Manago mentally competent after reading psychiatric reports.
Stone set a Jan. 19, 2016 trial date for Manago in El Cajon. He has pleaded not guilty to all charges and remains in the South Bay Detention Facility on $250,000 bail.
