Preliminary hearing set for cold case investigation of Lakeside murder

A preliminary hearing will resume on Jan. 13 for two men accused of killing Mark Randolph Vogler, 28, a carnival employee, after he left a Lakeside bar in 2008.

Both Destin Withers, 39, and Brian Baldino, 31, were charged with murder of Vogler, known by many as Randy Vogler, of Lakeside, in 2014 following a cold case investigation by the sheriff’s department.

Both Destin Withers, 39, and Brian Baldino, 31, were charged with murder of Vogler, known by many as Randy Vogler, of Lakeside, in 2014 following a cold case investigation by the sheriff’s department.

Testimony began Dec. 7 in El Cajon Superior Court and the hearing was temporarily recessed until after the holidays for convenience of many witnesses. Both men waived their right to have an uninterrupted hearing.

Vogler was shot and killed in February 2008. He worked for The Family Show amusement park that was set up a block from the Roundup tavern on Woodside Avenue. A tavern employee testified he saw Vogler “stumbling through the parking lot” after being shot and he fell down.

Withers is currently serving a prison term of 33 years to life in the 2012 shooting death of a young woman whose body was dumped along a road north of Escondido. Withers was convicted of first-degree murder, but he was not the gunman, who was sentenced to 100 years to life in prison.

El Cajon man convicted of carjacking and armed robbery

A jury has convicted John Ibrahim, 29, of carjacking and armed robbery of a pizza deliveryman who was held up on Feb. 23 in the 1100 block of W. Chase Ave. in El Cajon.

El Cajon Superior Court Judge John Thompson will sentence Ibrahim, of El Cajon, Jan. 12. Deputy District Attorney Daniel Shim said Ibrahim could get a maximum sentence of 12 years in prison.

Jessica Ann Garcia, 32, of El Cajon, pleaded guilty to robbery and was sentenced to 291 days in jail that she had already served. She was placed on three years probation and released from jail. Garcia was arrested in La Mesa while driving the getaway car not long after the carjacking. The victim’s cell phone, his vehicle, and most of his belongings were recovered except for about $80 in cash, said Shim. Ibrahim remains in jail.

Man sentenced to six years for theft and evasion

Shane Edward Hennes, 33, has been sentenced to six years in prison for stealing a car and evading El Cajon Police officers with reckless driving in which he eventually crashed into three parked cars.

Hennes pleaded guilty to burglary, resisting an executive officer, auto theft, driving on the wrong side of a highway while evading a police officer on an off-ramp from Interstate 8 on Greenfield Drive on July 17.

Hennes drove on Main Street and turned too quickly onto Broadway and crashed into three parked cars. He fled into a health care facility and ran into a break room. He slammed a large soda machine in front of the door and initially said he would not come out. He eventually surrendered.

El Cajon Superior Court Judge Daniel Goldstein denied probation and imposed consecutive sentences that also involved a second auto theft case. Hennes has a prior conviction for vandalism.
